The aim of the study is to investigate the rights of asylum seeking children in Denmark and Sweden, whether children rights actors in respective country consider these rights as being followed and whether these rights can be seen as comparable to the rights stated in the United Nations Convention on the Rights of the Child (CRC). The overarching question is which tensions between the CRC and the national legislation regarding asylum seeking children might exist and how the discourse regarding these rights vary between Denmark and Sweden. This is explored through analysis of national legislation concerning aliens and children and reports with critique from different children rights actors. The study shows that neither of the countries – in accordance with the children rights actors – can be seen as fully satisfying the rights of the child as stated in the CRC. The study also shows that there is a difference between the Danish and Swedish discourse regarding asylum seeking children’s rights. The standpoint of Denmark is - compared to the Swedish case - more aimed at separating the asylum seeking children from the children already citizens.sv
